ROCKLEDGE, PA – A 59-year-old Pennsylvania man faces first-degree murder charges after allegedly shooting his wife five times with her own firearm following an argument that began at a party, according to the Montgomery County District Attorney’s Office.
Jose Luna was charged with first-degree murder, third-degree murder, and prohibited possession of a firearm in the death of 48-year-old Alisett Schubert, court records show. The incident occurred Saturday night in the area of Fillmore Street and Huntingdon Pike in Rockledge.
According to an affidavit of probable cause obtained by The Philadelphia Inquirer, Luna and Schubert attended a party earlier that evening where she allegedly “disrespected him in front of others,” Luna told investigators. The couple argued as Schubert drove them home in her silver Nissan Murano.
Prosecutors said Schubert told Luna to exit the vehicle and walk home when they reached the intersection. The two then struggled over a .38 caliber revolver in her purse that was registered in her name, the affidavit stated. Luna allegedly secured the weapon and shot his wife.
“Oh my god!” Schubert reportedly screamed as she tried to flee the SUV, according to court documents. Luna then allegedly fired four additional shots.
A Southeastern Pennsylvania Transportation Authority bus driver witnessed the incident while driving in the area, according to the district attorney’s office. The driver said he heard two or three “pops” and saw a man exit the passenger seat before opening the driver’s side door, causing a woman to fall out of the vehicle.
The bus driver used his emergency system to report the shooting at approximately 10:05 p.m., providing a description of the suspect to authorities. Police found Schubert on the ground outside her vehicle with multiple gunshot wounds. She was transported to an area hospital where she was pronounced dead.
Philadelphia police located Luna about one mile from the scene. As officers approached, “he put a gun to his head and pulled the trigger, but the firearm was out of ammunition,” prosecutors said. He was arrested without further incident.
After the shooting, Luna allegedly called Schubert’s mother to inform her that her daughter was dead and that he wanted to kill himself, though he did not provide details about how she died, according to court documents.
The affidavit revealed a history of domestic violence, stating that Schubert had told a friend Luna was physically and mentally abusive. The friend reportedly witnessed Luna punch his wife in the face on at least one occasion.
Luna is scheduled to appear in court for a preliminary hearing on March 5. Rockledge is a borough in Montgomery County, Pennsylvania, located just north of Philadelphia.
